OPERATION OF ELECTRONIC DATA INTERCHANGE (EDI) SERVICE CENTER
IN THE FRAMEWORK OF FORWARDING ARRIVAL PLAN OF CARRIERS (RKSP),
INWARD MANIFEST AND OUTWARD MANIFEST
THE DIRECTOR GENERAL OF CUSTOMS AND EXCISE,
Considering :
- a. that delivery of Customs Declaration in the form of Arrival Plan of Carriers (RKSP), Inward Manifest and Outward Manifest from transporters or their proxies can be realized electronically through Electronic Data Interchange (EDI) System to Customs and Excise Service Office (KPBC) applying Customs EDI System;
- b. that in delivery of the customs declaration as meant in point a above, transporters or their proxies can realize it by using their computer apparatuses or through other Customs EDI apparatuses provided by provider of Customs EDI Service;
- c. that based on the considerations as meant in points a and b, it is necessary to stipulate a regulation on Operation of Electronic Data Interchange (EDI) Service Center in the Framework of Forwarding Arrival Plan of Carriers (RKSP), Inward Manifest and Outward Manifest;
In view of:
1. Law No. 10/1995 on Customs Affairs (Statute Book 1995 No. 75, Supplement to Statute Book No. 3612);
2. Regulation of the Minister of Finance No. 39/PMK.04/2006 on Procedures for Forwarding Arrival Plan of Inward Manifest and Outward Manifest of Carriers;
3. Regulation of the Director General of Customs and Excise No. P-10/BC/2006 on Procedures for Forwarding and Administering Notification About Arrival Plan of Carriers, Inward Manifest and Outward Manifest of Carriers;

THE REGULATION OF THE DIRECTOR GENERAL OF CUSTOMS AND EXCISE ON OPERATION OF ELECTRONIC DATA INTERCHANGE (EDI) SERVICE CENTER IN THE FRAMEWORK OF FORWARDING ARRIVAL PLAN OF CARRIERS (RKSP), INWARD MANIFEST AND OUTWARD MANIFEST
CHAPTER I
GENERAL PROVISION
Article 1
Referred to in this regulation as:
- 1. Provision of Electronic Customs-Data Interchange Service, hereinafter called EDI Service Center is service in the form of provision customs EDI apparatuses and other supporting facilities, which can be used by carriers or proxies in the framework of forwarding RKSP, Inward Manifest and Outward Manifest electronically through Customs EDI System.
- 2. Provider of Service for EDI Service Center is a business entity in the form of statutory body, which provides Customs EDI apparatuses and other supporting facilities usable by transporters or their proxies in the framework of forwarding RKSP, Inward Manifest and Outward Manifest electronically through EDI System.
- 3. Customs EDI Apparatus is computer hardware, network apparatus and software in the form of communication & software, carrier module and data entry module as well as other supporting apparatuses used for activity of data interchange in the framework of forwarding RKSP, Inward Manifest and Outward Manifest electronically through Customs EDI System.
- 4. User of Customs EDI Service is user of customs service, namely carriers or their proxies responsible for operation of carriers carrying goods and/or persons, already fulfilling the requirements for forwarding RKSP, Inward Manifest and Outward Manifest to KPBC.
- 5. Customs Declaration (CUSDEC) shall electronic customs declaration in the form of Arrival Plan of Carriers (RKSP), Inward Manifest and Outward Manifest using standards of UN/EDIFACT, which is conveyed electronically through Customs EDI System by users of Customs EDI Service to KPBC.
- 6. Customs Response (CUSRES) is electronic notification in the form of response or reply to CUSDEC, conveyed electronically through Customs EDI System by SAP PDE Manifest in KPBC to users of Customs EDI Service.
- 7. EDI Number is an identity number of provider of service for EDI Service Center, given by provider of electronic data interchange network service, which is used in Customs EDI System.
CHAPTER II
EDI SERVICE CENTER
Article 2
PDE Service Center only can be operated by business entities in the form of statutory bodies, which have meet the requirements and secured approval through stipulation as providers of service for EDI Service Center.
Article 3
Stipulation of companies as providers of service for EDI Service Center is done through a decision issued by the Director of Customs and Excise Information on behalf of the Director General.
Article 4
Procedures for securing the approval as meant in Article 2 are further regulated in the attachment to this regulation
Article 5
(1) Providers of service for EDI Service Center are obliged:
- a. To provide room and other supporting facilities needed for provision of electronic customs-data interchange service.
- b. To provide electronic customs-data interchange apparatuses usable in sending data electronically through Customs EDI System in accordance with the stipulated technical requirements;
- c. To examine the fulfillment of payment of Non-Tax State Revenue (PNBP) as requirement in forwarding Customs Declaration (CUSDEC);
- d. To send data about CUEDEC from transporters or their proxies through Customs EDI System;
- e. To convey data about Customs Response (CUSRES) to the dispatch of data as meant in point d to transporters or their proxies quickly and punctually.
(2) In sending data electronically, providers of service for EDI Service Center are obliged to have identity number in the form of EDI Number as providers of service for EDI Service Center.
Article 6
(1) Providers of service for EDI Service Center are responsible for secrecy of data and/or information received from transporters or their proxies, which are sent electronically through Customs EDI System.
(2) Providers of service for EDI Service Center are prohibited from :
- a. disseminating, publishing, transferring data or giving up data and/or receive sent or received through Customs EDI System to other parties.
- b. Changing improperly data and/or information sent or received through Customs EDI System in accordance with the provisions in force;
- c. Having or storing data and/or information sent or received through Customs EDI System without approval of transporters or their proxies.
- d. Transferring Customs EDI apparatuses to other parties without license of the Directorate General of Customs and Excise.
Article 7
(1) Providers of service for EDI Service Center are responsible for the smoothness of electronic dispatch and receipt of data through Customs EDI System.
(2) Transporters or their proxies are responsible for the truth and legitimacy of data and/or information in every element of data notified in Customs Declaration (CUSDEC), which are sent electronically through Customs EDI System.
Article 8
Organizers of EDI Service Center are obliged to perform bookkeeping and keep records related to services already provided for users of Customs EDI Service or 10 (ten) years.
CHAPTER IV
PERIOD AND REVOCATION OF APPROVAL
Article 9
(1) Stipulation of companies as providers of service for EDI Service Center to provide EDI Service Center as meant in Article 2 applies until revocation by the Director of Customs and Excise Information on behalf of the Director General.
(2) The revocation as meant in paragraph (1) can be done in the case of:
- a. providers of service for EDI Service Center failing to meet the provisions as regulated in this regulation and/or other legislation in the customs sector;
- b. providers of service for EDI Service Center not undertaking activity/business in one year continuously;
- c. on the basis of recommendation from the Head of Regional Office and/or Head of Customs and Excise service concerned, providers of services for EDI Service Center being implicated in violation of provisions of customs legislation;
- d. the relevant being declared bankrupt in accordance with the provisions of legislation in force;
- e. provider of service for EDI Service Center requesting for revocation.
CHAPTER V
MISCELLANY
Article 10
Heads of Regional Offices of the Directorate General of Customs and Excise in cooperation with the Directorate of Customs and Excise Information supervise and foster providers of service for EDI Service Center in the framework of forwarding Arrival Plan of Carriers (RKSP), Inward Manifest and Outward Manifest.
Article 11
The regulation comes into force as from the date of stipulation.
For public cognizance, the regulation of the Director General should be published in State Gazette of the Republic of Indonesia.
